1. Agreement to Terms

By accessing or using teqcustoms.com (the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Site.

2. Definitions

• "Company," "we," "us," or "our" refers to TEQ Customs.
• "You" or "User" refers to any person accessing the Site.
• "Products" refers to all goods and services offered through the Site.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

4. Account Registration

If you create an account, you agree to provide accurate, current information and to maintain the security of your credentials. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

5. Products, Pricing, and Availability

All Products are subject to availability. We reserve the right to modify or discontinue any Product at any time without notice.

Prices are subject to change without notice. We make reasonable efforts to display accurate pricing and Product information, but we do not warrant that descriptions, images, pricing, or other content is accurate, complete, reliable, current, or error-free.

6. Orders and Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to our acceptance. We may accept or decline any order at our discretion.

Errors: If a Product is listed at an incorrect price or with incorrect information due to typographical error, system error, or supplier pricing error, we reserve the right to cancel or refuse any order placed for that Product, whether or not the order has been confirmed and payment processed.

7. Right to Cancel and Refund Orders

We reserve the right to cancel and refund any order, in whole or in part, at our sole and absolute discretion, for any reason or no reason, at any time prior to shipment or delivery.

Reasons for cancellation may include, but are not limited to:

• Product unavailability or inventory discrepancies
• Pricing, description, or listing errors
• Suspected fraudulent, unauthorized, or illegal activity
• Suspected reseller, bulk, or automated purchasing activity
• Inability to verify payment, billing, or shipping information
• Violation of these Terms
• Shipping restrictions or logistical limitations
• Circumstances beyond our reasonable control
• Any other reason we deem appropriate in our discretion

In the event of cancellation, our sole obligation is to refund the amount paid for the cancelled items to the original payment method. Refund is your exclusive remedy. We shall not be liable to you or any third party for any loss, damage, cost, or expense arising from a cancelled order, including but not limited to lost profits, lost opportunity, price differences, or consequential damages.

Refunds are typically processed within 2 business days, though posting times depend on your financial institution.

8. Payment

You represent that you are authorized to use any payment method you provide. We may use third-party payment processors and are not responsible for their acts or omissions. All charges are in USD unless otherwise stated. You are responsible for any applicable taxes, duties, and fees.

9. Shipping and Delivery

Shipping timelines are estimates only and are not guaranteed. Risk of loss and title pass to you upon our delivery to the carrier. We are not responsible for carrier delays, loss, or damage in transit except as required by law.

10. Returns and Exchanges

Returns are governed by our Return Policy, incorporated here by reference. Custom, personalized, or made-to-order Products may be non-returnable except where defective.

11. Custom and Personalized Products

For custom orders, you are solely responsible for the accuracy of all specifications, artwork, text, and files you provide. You represent that you own or have permission to use all submitted content and that it does not infringe any third-party rights or violate any law. We may refuse to produce any custom order we deem offensive, infringing, or otherwise objectionable.

12. Intellectual Property

All content on the Site — including text, graphics, logos, images, designs, and software — is the property of the Company or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

13. User Content

By submitting content to the Site (reviews, images, custom design files, etc.), you grant us a non-exclusive, royalty-free, worldwide, perpetual, transferable license to use, reproduce, and display that content in connection with our business. You are responsible for the legality of content you submit.

14. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Use bots, scrapers, or automated systems to access the Site or place orders
• Attempt to gain unauthorized access to any portion of the Site
• Interfere with the Site's operation or security
• Resell Products without authorization
• Impersonate any person or entity

15. Third-Party Links

The Site may contain links to third-party websites. We do not endorse and are not responsible for third-party content, products, or practices.

16. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

Some jurisdictions do not allow the exclusion of implied warranties; these exclusions may not apply to you.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability; these limitations may not apply to you.

18. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party right.

19. Force Majeure

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, supply chain disruptions, government action, pandemics, or utility or internet failures.

20. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Wake County, North Carolina.

21. Dispute Resolution and Arbitration

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising from these Terms or your use of the Site shall be resolved by binding individual arbitration administered by [Arbitration Body] under its applicable rules, rather than in court, except that either party may bring a claim in small claims court.

Class Action Waiver: You and the Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to [email/address] within 30 days of first accepting these Terms.

22. Modifications to Terms

We may revise these Terms at any time. Changes are effective upon posting to the Site with an updated "Last Updated" date. Your continued use of the Site constitutes acceptance of the revised Terms.

23. Termination

We may suspend or terminate your access to the Site at any time, for any reason, without notice or liability.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

25. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other.

26. Entire Agreement

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and the Company regarding the Site.

27. Assignment

You may not assign these Terms. We may assign our rights and obligations without restriction.

Warranty

We stand behind all of our products and are proud to offer a warranty on everything we produce. This warranty ensures products are free from defects and major issues.

What is Covered

Headlights

• All Retrofit headlights are covered by a 2 year warranty. 

• The warranty for headlights includes all installed headlight components (Halos, strips, demon eyes, projectors)

• The warranty policy covers the headlights against water entry. As the weather changes, there may be occasional condensation- do not worry, this is completely normal. Ensure all bulbs and all provided dust boots are installed. 

• HID Wiring components (ballasts, bulbs, and harnesses) are considered a wear and tear item and will be covered by a 1 year warranty, or the manufacturers warranty, whichever is greater. 

Other TEQ Products

• Raptor Lights are covered under a 1 year warranty. 
• Glow Gauges carry a 2 year warranty. 
• All TEQ Customs Tail Lights are covered under a 2 year warranty. 
• Gusseted Spindles carry a Lifetime Structural Warranty. This warranty covers the spindle and gussets against cracking, bending, or any other damage that would compromise the structural integrity. 

3rd Party Products

• As authorized dealers for the 3rd party products we sell, any manufacturers warranties will apply to 3rd party products purchased through TEQ Customs. 

What is Not Covered

• Cosmetic issues or shipping damage will not be covered once the headlights are installed. If your headlight arrives with damage, contact us within 14 days of delivery to utilize the included shipping insurance. Once contacted, we will file the claim and remedy the issue. After 14 days or installation, we are unable to accept any claims for cosmetic issues or shipping damage. 
• Any damage arising from improper use (trail damage, vehicle accidents, products used for racing, or damage arising from unlawful vehicle operation)
• Normal wear and tear items, such as scratches and fading of the lens are not covered. For the best long term appearance, we recommend installing PPF on the headlight lens. PPF has greater longevity than any coating, typically 8-10 years. 
• Headlights that have been opened by the customer or another third party, or altered internally in any way. 

Warranty Terms and Conditions

• It is the sole discretion of TEQ Customs to determine warranty eligibility.
• All products must be installed using our recommended procedures. Failure to do so may result in a voiding of the warranty. Please reach out to us with any questions.
• The warranty only applies to the original purchaser of the product. 
• We honor ALL manufacturers warranties for products produced by our vendors. 

All warranty requests must be made in writing to info@teqcustoms.com. We do not accept warranty requests in any other format. 

Disclaimer

TEQ Customs LLC's offering of a repair or replacement product is the exclusive remedy provided under this warranty. Damage to a purchasers vehicle or any other equipment is not covered under this warranty. TEQ Customs's sole liability to the customer falls within this policy set forth above. TEQ Customs LLC will not be liable for any installation costs, lost profits, lost sales, or for any consequential, direct, indirect, incidental, special, exemplary, or punitive damages or for any other damages of any kind or nature.

Lead Times

Lead times for all products are noted directly under the product title on each individual product page. Lead times are published as clearly as possible, and it is the customers responsibility to read and understand the advertised lead times. 

Lead times are considered our best estimate for when the certain item will ship. While this is not a deadline, we build in extra time into our quoted lead times to account for potential issues and delays. 

Discounts

Discount codes do not stack. Items that are marked down are not subject to any additional discounts.
